Driving Under OVI or DUI Suspension

A conviction for driving under a DUI or OVI Suspension carries a mandatory 3 days in jail and up to 180 days in jail.

Many times people are charged under this section for driving outside of their driving privileges or driving without any privileges.

Defenses

Just because you were charged with driving under suspension does not mean you have to plead guilty. There are defenses!  The BMV and police officers do make mistakes.  Many times police officers charge people under the wrong section, or the BMV did not update a person’s driving record.

More importantly, the burden is on the prosecution to prove every element of the violation beyond a reasonable doubt.

Other Options

There are options other than going to trial.  It is possible to work out a plea, where the suspension is reduced to a charge that does not carry the mandatory 3 days in jail.
