Drivers License Problems
Driving Under Suspension
Not all suspension charges are the same. Penalties may include mandatory jail time, fines or a longer suspension.
Just because you were given a ticket does not mean you have to plead guilty. There are defenses! The BMV and police officers do make mistakes. Many times police officers charge people under the wrong section, or the BMV did not update a person’s driving record. More importantly, the burden is on the prosecution to prove every element of the violation beyond a reasonable doubt.
There are many options besides winning at trial. Many times it is possible to work out a plea, where the suspension is reduced to a violation that does not carry points or other penalties. This reduction can save you money in the long run.
